Definitions

‘MHPM’ (Maharashtra Packers & Movers Association) Created for the purpose of enhancement of mutual co-operation amongst members/uplifting of sector ,making the sector much organise.

Member : Members means every person, body of individuals/ company/partnership form sole proprietorship firm having same business associated with us.

Quality : Quality means the standard set by Associationtime to time for betterment of Relocation Sector.

Rules : Rules and regulations made and levied by Associationupon its members.

Customer : Third party for AssociationHousehold , Company, Body of Individual, Partnership firm.

Breach : Any breach shall be come under the ambit of Criminal breach of trust as the Associationis working solely upon trust amongst members.

A.G.M : Every member has to attend the annual general meeting and need to provide their valuable feedback comment suggestion.

In the event of any conflict or inconsistency between this document and any of the association operator procedure, technical specification and recommendation for use of personal data t hen this document will prevail.

Membership

1. Anyone can attain the membership who is willing to grow mutually and agreed upon the terms and conditions set by association i .e. MHPM Association’ (Maharashtra Packers & Movers Association)

2. Eligibility for membership and the enrolment process is set out in the AssociationOperator Procedures. One has to make himself clear by providing his written consent to Association.

3. Membership of the association is conditional upon the Member accepting and abiding by these Rules and the Member acknowledges that these Rules are binding upon and enforceable against the Member by the Board of members of association.

4. A member can retain his membership until any breach done by Member or with the consent of MHPM. The MHPM is having the sole authority upon deciding the membership eligibility.

5. The Member acknowledges that the Board of members of association may increase/ introduce charges/ renewal fees to cover its costs in administering/facilitating the Association. Such charges will only be introduced following consultation with the funding community and following a reasonable period of notice. If the Member is unwilling to pay such charges, it may withdraw from the association till the forthcoming AGM

Rules which apply to all Members

1. The Member warrants and undertakes that :

This M.O.U. shall be valid /enforceable for a maximum period of 11 months and shall be read and signed by concerned parties on a stamp after paying the requisite stamp duty as prescribed by stamp act levied by government of State concerned.

The members are require to pay the fees levied by association and also require to provide feedback time to time for betterment of Federation. The MoU shall be the subject of auto renewal after a period of every 11 months. The members are require to read and signed this agreement on every renewal.

MHPM is having right to attain/keep/ask /Furnish itself with the complete information of its members such as full details which include name and address of business, TIN/GST/PAN/Audited Balance Sheets, Account, number and other details, Association finds suitable and necessary, can cross verify the details with the concerned authority in respective state.

The responsibility of MHPM for its members is to making them update/ educate /suggest /Assist and the members have to follow those suggestions/guidance in case of vis versa the Association shall not be responsible.

MHPM is having the right to add/ debarred any of its members in case of finding of any breach of trust and MHPM can take action against that member accordingly. MHPM is having all right to access the records of its members if required monthly or annually.

In case of, any member’s existence within an initial period of 3 years the Associationwill presume that the particular member has joined the Association with intention to cheat by misusing the contacts provided by Association, in such case the Association will take necessary action against that member and Association shall not be responsible for any of act of that particular member against the members as well as against the customer. One cannot blame the Association for defraud done by any intended member with guilty mind.

MHPM is with a purpose to grow with mutual cooperation amongst its members so every member is bound to be faithful honest. There should be no place for Coercion undue influence fraud and misrepresentation.

In case of any dispute created amongst its members the MHPM has all right to resolve the dispute and the step taken by MHPM has to be accepted by all its members.

MHPM has right to use the name and other details of its members when require, prior permission is not mandatory, only for the purpose of awareness.

To maintain the extreme level of dignity integrity and honesty amongst its members, towards each other’s as well towards customers shall be the foremost concern of MHPM.

To achieve above mentioned targets MHPM is free to take necessary action/arrangements need to made without any more written consent of any of its members. The signature will suffice the consent of members.

This agreement must be considered as a tripartite agreement with member to member and member to customer. In case of any dispute MHPM shall have the right to gather the information regarding the clients/customers from its members if required.

Keeping an eye on its members regarding behaviour with members and customers is also the responsibility of MHPM in pursuant to that MHPM can take all necessary action by tracing the members, keeping an eye through any means shall be a prior given consent by all its members.

2. The disputes amongst members with each other or with MHPM shall be a subject of court of Arbitrator situated herein MUMBAI.

3. MHPM is solely having the right to keep an eye on whether Members are using appropriate prescribed packing materials to protect customers’ goods. Specialist protection and equipment, (i.e. sofa covers, table top protectors, piano trolley/shoe) should be used whenever appropriate

MHPM will make sure It would be duty of member towards Customers that customer should be made aware of the range of packing materials available, (i.e. wardrobe boxes, book boxes, etc). Reusable protection should be used when possible, to reduce environmental impact and costs.

4. MHPM is having its registered Office in MUMBAI Maharashtra the Jurisdiction shall lie the concerned court situated in MUMBAI Only.

5. None of Member of Association is responsible for any act of god, nor the customer can claim for any compensation.

Training of Staff and Quality Control

1. The member shall ensure that all staff agrees to abide by the Code of Ethics and a copy must be available to all staff. Which can be availed by mail at info@mhpmassociation.com?

2. All staff shall undergo an induction process which should include manual handling training and statutory health and safety instruction.

3. Staff shall take part in a continuing training programme, which shall be recorded by the Member and/ or MHPM. Performer participants will get a certificate of participation/ excellence from MHPM.

Members’ of MHPM has to Maintain the charges/ business quotations/proposals/services at very competitive level, the pricing should not be very high or very low in any case and require to clear the payment within 48 hrs of satisfactory delivery of work/assignment/job.

In every annual general meeting apart from their complaints and suggestions every members are required to deposit the charges levied by MHPM time to time on a regular interval through cheque or cash.

Every member of MFHPM and their staff has to ensure or make them sure that the staff and member shall wear the dress prescribed by MHPM during the course of employment/while taking the goods from one place to another

4. Staff shall be presentable, polite, punctual and uniformed as per MHPM.

5. Staff shall be prohibited from actions and conduct that damage the company & Association image, including (but not limited to) swearing, smoking use of alcohol/drugs and littering on or near the customer’s premises

6. Apart from MHPM it is the duty of every Member and their staff to behave properly and follow all the guidelines and keep themselves updated as well as the Association.

7. The Association will charge a minimum fee for the services provided to its members to maintain the office /staff /stationary and to bear other expenses of the Association will have the sole discretion to decide the charge.

Fee, Charges and Penalties

1. Apart from the membership fee, Association will charge from its members a set percentage (5%) on billing as a service & support fees against the carried businesses within the members/network on each bill. Members’ agreed to deposit the fee on regular basis, if failed by any mean a penalty of 2% per month would be charged on total dues.

Types of Fee that Every Member agreed to pay. 1. Membership Fee (As Decided in AGM) 2. 5% of each billing done by/within members or the percentage as decided in AGM) 3. National Conference Fee (As on actual or As decided by MHPM)

2. The members are require to deposit the membership fees yearly, and it is also the duty of every member to provide the statements or the details of transaction they made in respect of member to member business. The Association shall have the right to waive/reduce any charges/fee of any of its member on special circumstances with the consent of all Board of Members of Association

3. The members are require to pay in excess if they avail/utilise services like G.P.S. tracking, warehouse, co-working spaces, IT/ITES services, Toll-free, Dedicated Customer Support, SaaS (Software as Service) charges, mobile applications, updation of status through messages, warehouse/maintenance facility as per the terms and conditions decided upon mutual consent.

4. Penalties If the members are fail to join the National Conference/AGM/ paid workshop/seminars/training, and do not disclose the valid reason behind it in written to the Association, the association is free to cancel the candidature of that members and the member shall not be allowed to work with any member of the Association. In case of finding-of doing so the Association shall act accordingly. The Association can take legal action against such members to recover the damages/losses/fees/charges.

Breach

1. If any of its members found guilty by misusing the name/ Brand MHPM he shall be barred to do business with any of MHPM associated members or customers for a maximum period of 3(Three) years and in case debarred member shall found doing so, MFI can take legal action against such member before court with competent Jurisdiction.

During this period of 3 years the barred member is not allow to get in touch with any other member of association nor the barred member can approach to the customer on behalf of Association .

2. The Association shall not allow any of its member to create /Form/join any kind of parallel group organization which can harm the reputation/business of other members.

3. The members are bound to obey the rules made by Association and in case of any hurdles founding in doing so the member has to inform the Association in written and can ask the association about the steps taken by Association resolve the issue.

Dispute Resolution

1. In case of a dispute between members to members the decision of Association shall be final

2. In case of dispute between members to customer the Associationshall try to settle/negotiate the matter in case of failure in doing so the concerned party can go to court with competent jurisdiction, in such case the Association will have no role directly or indirectly.

3. Members can discuss their disputes in A.G.M. or may approach the Association anytime with a written request. MHPM will not be responsible in any mean for the undisclosed businesses done within the members and treat this a wilful practice and take action against involved members.

4. The Jurisdiction of Concerned court situated herein MUMBAI shall be the place in case of any kind of dispute with Association.

The member needs to approach any of the members of the Board first with written concern.

The Members have to give prior information to Association about their dispute so that Association can look for alternative

In such case the Association is free to outsource the resources. Or the member can outsource with the permission of Association. Every members of MFHPM has to connect and allow to do business with only members associated with MHPM only. Because here at MHPM our prime concern is to maintain a healthy environment and making this sector more organised, that would be possible only when we work as a team. In situation where one member is finding it hard to connect with other member of MHPM it would be the prime duty of that member to inform the MHPM about the situation, in such condition the MHPM will provide the list of executive members and in case of MHPM is not having any member there, the member will be free to outsource with a written consent from MHPM. The consent letter shall be taken as record.

Cessation of Membership The membership of any member can be cease on any of the following ground

1. If the member Associated with Association is found in Any kind of coercion defraud with customer or government by doing any illegal act the membership of that member shall be liable to cease without any intimation.

2. In case of above mentioned criminal breach of trust the membership can be ceased the member shall not be eligible to join the Association again.

3. The members are not allowed to form any more association of similar nature .In case of finding so; the membership of that member shall be cease.

Annual General Meeting (AGM)

It is mandatory to attend/join AGM, during the national conference by its every member/or their official representative. The Association shall organize annual general meeting every year, the information regarding that shall be circulated/published amongst member through any means of communication such as email whatsapp or over phone call it would be duty of every member to educate motivate encourage maximum number of people doing same kind of business to join the Association and provide them the information regarding benefits of joining the Association. The Association will flourish only with the support of every member of Association and maximum number of satisfied customers.

Disclosure of Business

Every member of Associationis allowed to disclose it’s business and provide a copy of their records to Association, the Association n will keep a copy for any further reference.

Rewards & Support

Here at MHPM we work like a family when any member of family receives any appreciation the whole family feels proud, same concept we apply on all our members. The good work shall always get an appreciation awarding them in an appropriate manner shall be the responsibility of MHPM. It would be duty of every member to ask for feedback and provide us a copy of same and in case of customer asking for any other assistance the member is bound to provide that assistance/information to its customer with permission from MHPM. Members are allowed to conduct Awareness programs in their respective cities on prior written approval/ acceptance by MHPM in which MHPM may arrange/pay/reimburse the cost of operation.
